Sex assault charges filed against Hamilton man

A Hamilton man faces several charges after allegedly assaulting two girls in his home.

Hamilton Police say Dwayne Smith, 38, was driving a green Dodge pick-up truck around Cannon Street and Sherman Avenue on Oct. 3. The area is a largely residential neighbourhood in Stipley just north of King Street.

He pulled up beside two girls and asked if they wanted a ride. The girls got in his car and, police say, Smith took them back to his house. According to investigators he assaulted the pair at his home.

The girls later reported the assaults on Oct. 13. On Oct 17, police announced Smith was later arrested and charged with:

  • two counts of sexual assault
  • two counts of sexual interference, and
  • possession child pornography

Investigators believe Smith may have harmed other victims. Anyone with information can call the Hamilton Police Crimes Against Children’s Unit at 905-540-6254 or Crime Stoppers at 1-800-222-8477.

“Hamilton Police want all survivors of sexual violence to know that we believe them and we will respect their choice when and how they report an incident,” investigators wrote.

There is no statute of limitation on sexual assault. Survivors can report such crimes at any time, even years after the initial incident.

“There is no guaranteed way to prevent a sexual assault,” police continued, “Sharing the details of this assault is intended to provide the community information, and people are encouraged to trust their instincts.”
