Police in Mississauga cleared after man suffered broken bones in arrest

Two police officers in Mississauga have been cleared after a man suffered a fractured elbow and wrist during an late-night arrest in January.

The incident, according to the findings of the Ontario Special Investigation Unit (SIU), occurred around 2:45 p.m. on Jan. 27 after a resident contacted Peel Regional Police to report what he believed was a fraudulent Kijiji transaction. When the responding officers pulled up at the residence near Winston Churchill and Erin Centre boulevards, a man in Volkswagen Tiguan attempting to drive away.

Officers who struck the vehicle’s driver side and passenger side with cruisers. The man then exited his vehicle through the front-seat passenger’s window, and was collared after a foot pursuit.

The SIU, which has a mandate to investigate when someone is injured or dies during an interaction with police, said Friday that it could not find that the officers’ conduct was unlawful. Director Joseph Martino also said it was unclear how the complainant, a 23-year-old man, suffered the fractured elbow and wrist.

“There were no reasonable grounds to believe that either subject official comported himself unlawfully in their engagement with the man,” a press release said. “As there was no basis for proceeding with criminal charges in this case, the file has been closed.”

Peel Regional Police provided footage from body-worn cameras (BWCs) from five different police officers.

Both subject officers exercised their legal right to decline an interview with the SIU. One officer provided their case notes.
