Cop charged with assault in Niagara-on-the-lake

A Niagara police officer has been charged with assault after an investigation into a physical dispute from this summer.
During an internal investigation, it was revealed that, while responding to the call for service, an on-duty member of the Niagara Regional Police Service (NRPS) became involved in an alleged altercation with a suspect.
The NRPS report indicated the incident occurred on August 5, 2024, following a call for police assistance at a home in the Town of Niagara-on-the-Lake.
To prevent any internal bias, NRPS brought in members of the Hamilton Police Service to investigate the matter.
As a result of the investigation, yesterday (Nov. 26) Constable Ben Tomiuck was arrested and charged with assault.

Tomiuck has since been released from custody and is scheduled to attend court on January 2, 2025.
The report indicated that Tomiuck had been engaged in active duty with the NRPS for 23 years and was assigned to a general patrol position in Niagara Falls/Niagara-on-the-Lake at the time of the alleged offence.
